1. Acceptance of Terms
By accessing or using WeSightRead ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
WeSightRead is an online music sight-reading practice platform that allows users to:
- Create and host interactive sight-reading practice sessions
- Join practice sessions to improve sight-reading skills
- Generate customized musical exercises for various instruments
- Practice with real-time music notation
3. User Accounts
3.1 Account Creation
To use certain features of the Service, you must create an account through Google OAuth authentication. You agree to provide accurate, current, and complete information during the registration process.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we deem harmful to the Service or other users.
4. Subscription and Payment
4.1 Subscription Required for Hosting
Creating and hosting practice sessions requires an active paid subscription. Joining sessions as a participant does not require a subscription.
4.2 Free Trial
New users may receive a 7-day free trial of the subscription service. The trial is available only once per user. After the trial period, your subscription will automatically renew unless canceled.
4.3 Payment Processing
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.
4.4 Refunds
Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time to prevent future charges.
4.5 Price Changes
We reserve the right to modify subscription pricing. We will provide at least 30 days' notice of any price increases to existing subscribers.
5. User Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated scripts, bots, or other automated means to access the Service
- Harass, abuse, or harm other users
- Upload or transmit viruses, malware, or other malicious code
- Reverse engineer, decompile, or disassemble any part of the Service
- Share your account credentials with others
6. Intellectual Property
6.1 Service Content
The Service, including all software, algorithms, user interfaces, and generated content, is owned by WeSightRead and is protected by copyright, trademark, and other intellectual property laws.
6.2 License to Use
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
6.3 Generated Music Exercises
Music exercises generated by the Service are intended for personal practice only. You may not distribute, publish, or commercially exploit the generated content without prior written permission.
7. Privacy and Data
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WESIGHTREAD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless WeSightRead and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through a notice on the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
14. Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if they qualify.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeSightRead regarding the Service and supersede all prior agreements and understandings.
